These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and any related applications (collectively, the “Services”) provided by Igbospeak (“we,” “us,” or “our”).

 

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services. We may update these Terms from time to time, and we will notify you of significant changes by posting the updated version on our website or emailing you. Your continued use after changes constitutes acceptance.

 

These Terms incorporate our Privacy Policy, which explains how we handle your data.

 

1. Eligibility

 

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. If you are under 18, you may use the Services only with the involvement and consent of a parent or guardian. By using the Services, you represent that you meet these requirements.

 

2. User Accounts

 

To access certain features, such as booking tutoring sessions or tracking progress, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and account.
  • Notify us immediately of any unauthorized use at support@igbospeak.com.
  • Be responsible for all activities under your account.

 

We reserve the right to suspend or terminate accounts that violate these Terms.

 

3. Description of Services

 

Igbospeak offers online Igbo language tutoring, including live sessions with certified tutors, self-paced lessons, quizzes, and community forums. Services may include premium content available for purchase. We strive to provide high-quality, culturally accurate Igbo learning experiences, but content is for educational purposes only and not a substitute for professional language certification.

 

4. Payments and Billing

 

  • Fees: Certain Services require payment (e.g., tutoring packages). Prices are listed on the website and subject to change. All fees are in [e.g., USD or NGN—specify your currency] and exclude applicable taxes.
  • Payment Methods: We accept payments via secure third-party processors (e.g., Stripe, PayPal). You authorize us to charge your chosen method for purchases.
  • Subscriptions: If applicable, subscriptions renew automatically unless canceled. You can manage subscriptions in your account settings.
  • No Hidden Fees: We do not charge hidden fees, but third-party providers may apply transaction costs.

 

5. Refund Policy

 

We want you to be satisfied with your Igbo learning experience. Refunds are handled as follows:

 

  • Tutoring Sessions: Full refunds for unbooked sessions if requested within 7 days of purchase. For booked sessions, refunds are available if canceled at least 24 hours in advance (minus any processing fees). No refunds for completed sessions or no-shows.
  • Premium Content/Subscriptions: Refunds for subscriptions within 14 days of initial purchase if no content has been accessed. After that, no refunds for partial months; you can cancel to prevent future billing.
  • Technical Issues: If a session is disrupted due to our technical fault, we will reschedule or refund at our discretion.
  • Process: To request a refund, email support@igbospeak.com with your order details. Refunds are processed within 7-10 business days to your original payment method. We reserve the right to deny refunds for abuse or violations of these Terms.

 

All refunds are subject to review and may be prorated.

 

6. User Conduct

 

You agree not to:

 

  • Use the Services for illegal purposes or in violation of any law.
  • Harass, threaten, or discriminate against tutors, users, or staff.
  • Upload harmful content (e.g., viruses, spam) or infringe on intellectual property.
  • Record sessions without consent or share proprietary Igbo learning materials outside the platform.
  • Create multiple accounts to exploit promotions.

 

Violations may result in account suspension, session cancellation without refund, or legal action.

 

7. Intellectual Property

 

All content on Igbospeak, including lessons, quizzes, videos, and Igbo language resources (“Content”), is owned by us or our licensors and protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive license to access Content for personal, non-commercial use. You may not copy, distribute, modify, or create derivative works without our written permission.

 

User-generated content (e.g., forum posts) remains yours, but you grant us a royalty-free license to use it for operating and promoting the Services.

 

8. Termination

 

We may terminate or suspend your access to the Services at any time, with or without notice, for violations of these Terms or other reasons. Upon termination, your right to use the Services ends, and we may delete your data (subject to our Privacy Policy). Sections that survive termination include Intellectual Property, Disclaimer, Limitation of Liability, and Governing Law.

 

You may terminate your account at any time by contacting support@igbospeak.com.

 

9. Disclaimer and Limitation of Liability

 

The Services are provided “as is” without warranties of any kind. We do not guarantee uninterrupted access, error-free Content, or specific learning outcomes. Tutors are independent contractors, and we are not responsible for their actions.

 

To the fullest extent permitted by law, Igbospeak, its affiliates, and agents shall not be liable for indirect, incidental, consequential, or punitive damages arising from the Services, even if advised of the possibility. Our total liability shall not exceed the amount you paid us in the past 12 months.

 

10. Indemnification

 

You agree to indemnify and hold harmless Igbospeak, its officers, employees, and tutors from any claims, losses, or damages arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

 

11. Governing Law and Dispute Resolution

 

These Terms are governed by the laws of Nigeria (or [specify your jurisdiction]). Any disputes shall be resolved through binding arbitration in [e.g., Lagos, Nigeria], or in small claims court if applicable. You waive any right to class actions.

 

12. Miscellaneous

 

  • Force Majeure: We are not liable for delays due to events beyond our control (e.g., natural disasters).

Terms for Tutors/Instructors

 

If you are a tutor or instructor (“Tutor”) providing Igbo language lessons on Igbospeak, the following additional terms apply. These supplement the general Terms above.

 

12.1 Tutor Eligibility and Onboarding

 

  • You must be a qualified Igbo speaker with relevant teaching experience or certifications (e.g., native fluency, teaching credentials). Submit proof during application.
  • We review and approve Tutor applications at our discretion. Approved Tutors must complete onboarding, including background checks if required.
  • You represent that you are legally authorized to work as a Tutor in your jurisdiction.

 

12.2 Tutor Responsibilities

 

  • Provide accurate, high-quality Igbo lessons in a professional manner.
  • Adhere to scheduled sessions; notify us and students of cancellations at least 24 hours in advance.
  • Maintain confidentiality of student information per our Privacy Policy.
  • Use platform tools (e.g., video chat) appropriately and report technical issues promptly.
  • Comply with all laws, including those related to education and data protection.

 

12.3 Compensation

 

  • Tutors earn a commission per session or package, as agreed in your Tutor agreement. Payments are processed [e.g., monthly] via [e.g., bank transfer or PayPal], minus platform fees.
  • You are responsible for your own taxes and expenses.
  • We may withhold payments for disputes, violations, or chargebacks.

 

12.4 Content and Intellectual Property

 

  • Any materials you create or upload (e.g., custom Igbo exercises) become part of the platform. You grant us a perpetual, royalty-free license to use, modify, and distribute them.
  • Do not use copyrighted materials without permission.

 

12.5 Conduct and Prohibitions

 

  • Treat students respectfully; no discrimination, harassment, or inappropriate behavior.
  • Do not solicit students off-platform or compete directly with Igbospeak.
  • Report any student misconduct to support@igbospeak.com

 

12.6 Termination for Tutors

 

  • We may terminate your Tutor status for poor performance, complaints, or violations. You may terminate by giving [e.g., 30 days] notice.
  • Upon termination, unpaid earnings will be settled, and access to Tutor tools revoked.

 

12.7 Liability

 

  • As an independent contractor, you are solely responsible for your lessons and interactions. Igbospeak is not liable for disputes between you and students.
